These Terms and Conditions (“Terms”) govern your use of ondutystore.com and any purchase made from Streber LLC d/b/a On Duty Uniforms (“On Duty Uniforms,” “we,” “us,” or “our”).

By accessing the website, creating an account, submitting an order, or purchasing a product, you agree to these Terms and our Privacy Policy and Shipping and Returns Policy.

Do not use the website if you do not agree to these Terms.

1. Eligibility and Lawful Use

You must be legally capable of entering into a binding agreement to make a purchase through the website.

You agree to use the website and products only for lawful purposes. You may not use the website to:

  • Violate any federal, state, or local law

  • Impersonate another person, department, agency, or organization

  • Submit false, misleading, or fraudulent information

  • Interfere with website security or operation

  • Attempt to gain unauthorized access to an account, system, or network

  • Copy, scrape, reproduce, or commercially exploit website content without authorization

  • Purchase, possess, display, or use a restricted product unlawfully

We may refuse service, restrict access, cancel an order, or close an account when we reasonably believe these Terms have been violated or that a transaction may be fraudulent or unlawful.

2. Product Information

We attempt to describe and display products accurately. However:

  • Product colors may vary by screen or device

  • Manufacturers may change product specifications, packaging, materials, or design

  • Images may show optional accessories or decoration not included with the product

  • Measurements and sizing information are approximate

  • Product availability may change without notice

You are responsible for reviewing product descriptions, sizing information, color selections, quantities, customization instructions, and compatibility before submitting an order.

3. Orders and Acceptance

Your submission of an order is an offer to purchase and does not constitute our acceptance.

We may review, decline, limit, or cancel an order for reasons including:

  • Product unavailability

  • Pricing or description errors

  • Suspected fraud

  • Payment authorization issues

  • Shipping restrictions

  • Legal or regulatory requirements

  • Department-program restrictions

  • Inability to verify customer or order information

An order is accepted when we confirm acceptance or begin processing or fulfilling it.

If we cancel a paid order, we will issue an appropriate refund to the original payment method.

4. Prices, Taxes, and Payment

Prices are displayed in United States dollars unless otherwise stated.

Prices, promotions, product availability, and shipping charges may change without notice. The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors.

Applicable sales tax, shipping charges, customization fees, alteration fees, and other charges will be displayed during checkout or communicated before the work is authorized.

You represent that:

  • The payment information you provide is accurate

  • You are authorized to use the payment method

  • Sufficient funds or credit are available

  • You authorize us and our payment providers to charge all amounts associated with the order

5. Pricing and Website Errors

We may correct typographical errors, inaccurate product information, incorrect promotions, inventory errors, or pricing mistakes at any time.

When an error affects an order, we may contact you for instructions, offer the correct terms, or cancel and refund the affected portion of the order.

We are not obligated to fulfill an order at an obviously incorrect price.

6. Product Availability and Backorders

Items shown as available may become unavailable before an order is fulfilled.

Some products may be sourced from manufacturers or distributors after an order is placed. Estimated availability and shipping dates are not guarantees.

If an order cannot be shipped within the stated or legally permitted timeframe, we may contact you regarding the delay and provide available options, which may include consenting to the delay, substituting an item with your approval, or canceling the affected item for a refund.

7. Alterations, Decoration, and Customized Products

Altered, decorated, or customized products include, without limitation:

  • Hemmed garments

  • Garments that have been taken in, let out, tapered, shortened, lengthened, or otherwise modified

  • Embroidered products

  • Screen-printed products

  • Heat-applied or transfer-printed products

  • Engraved or personalized products

  • Products with names, titles, badge numbers, department identifiers, logos, insignia, patches, emblems, or custom lettering

  • Products manufactured or modified according to customer instructions

You are responsible for confirming all sizes, colors, quantities, spellings, artwork, logos, placement instructions, and alteration measurements before approving an order.

Once alteration, decoration, customization, or production has begun, the order generally cannot be changed or canceled.

Except where required by law or where the product is defective due to our error, altered, decorated, or customized merchandise is final sale and is not eligible for return, exchange, refund, or store credit.

8. Artwork, Logos, and Customer-Submitted Materials

When you provide artwork, a logo, trademark, badge, seal, insignia, emblem, name, or other material, you represent and warrant that:

  • You own the material or have permission to use it

  • Our reproduction of the material will not violate another party’s rights

  • You have any required authorization from the applicable department, agency, employer, organization, or trademark owner

  • The requested use is lawful

You grant us a limited license to reproduce, modify, format, and use submitted materials as necessary to quote, produce, and fulfill the order.

We may reject any artwork or customization request that we believe may be unlawful, infringing, deceptive, offensive, unauthorized, or inconsistent with our business policies.

You agree to be responsible for claims, losses, or expenses arising from materials or instructions you provide, except to the extent caused by our own unlawful conduct.

9. Department and Agency Products

Certain uniforms, badges, patches, emblems, insignia, identification products, or restricted equipment may require proof of employment, agency authorization, approval from a department administrator, or other documentation.

We may contact a department, employer, agency, or authorized administrator to verify eligibility or obtain approval.

Submitting an order does not guarantee approval. We may refuse or cancel an order when authorization cannot be verified.

Customers may not purchase, display, or use uniform items, insignia, or identification products for impersonation, misrepresentation, or any unlawful purpose.

10. Department Ordering Portals

Certain customers may receive access to department-specific ordering portals, allowances, products, pricing, or approval workflows.

Portal purchases may be subject to additional terms established by the participating department or organization, including:

  • Spending limits

  • Approved product lists

  • Required administrator approval

  • Payroll-deduction or allowance rules

  • Pickup or delivery restrictions

  • Employment or membership verification

Department administrators may be able to view information related to purchases submitted through their organization’s portal.

We may suspend portal access when directed by the participating organization or when eligibility cannot be verified.

11. Firearms and Ammunition

The website may advertise or provide information concerning firearms, ammunition, and related products. Firearms and ammunition are not available for direct online checkout through ondutystore.com.

Website listings are informational and do not constitute approval of a sale, transfer, possession, or delivery.

Any firearm or ammunition transaction must be handled separately and is subject to all applicable:

  • Age and identification requirements

  • Background checks

  • Licensing requirements

  • Transfer procedures

  • Waiting periods

  • Residency requirements

  • Federal, state, and local restrictions

We may refuse any transaction that we believe is prohibited, unsafe, suspicious, or otherwise inconsistent with applicable law or company policy.

Nothing on the website constitutes legal advice regarding the ownership, possession, transportation, transfer, or use of firearms, ammunition, knives, body armor, or other regulated products.

12. Shipping, Pickup, Returns, and Refunds

Shipping, store pickup, returns, exchanges, and refunds are governed by our Shipping and Returns Policy, which is incorporated into these Terms.

Customers are responsible for providing a complete and accurate shipping address. Additional charges resulting from an incorrect address, refused shipment, or unclaimed package may be deducted from a refund or charged to the customer where permitted.

13. Order Cancellation

Orders for standard, unaltered, and undecorated merchandise may be canceled before processing or fulfillment begins, subject to our approval.

Orders cannot ordinarily be canceled after:

  • Alteration has begun

  • Decoration has begun

  • Custom products have entered production

  • An item has shipped

  • A supplier has imposed a noncancelable charge

Contact us immediately at cs@ondutystore.com or 845-809-3037 to request cancellation. We cannot guarantee that a cancellation request will be received before processing begins.

14. Promotions and Discount Codes

Promotions and discount codes:

  • Are valid only during the stated promotional period

  • May be subject to product or customer restrictions

  • May not be combined unless expressly stated

  • Have no cash value

  • May be limited to one use per customer or order

  • May be changed or withdrawn where legally permitted

We may reject or cancel the unauthorized, fraudulent, or unintended use of a promotion.

15. Intellectual Property

The website and its content, including text, photographs, graphics, logos, icons, product arrangements, software, and page design, are owned by or licensed to On Duty Uniforms and are protected by applicable intellectual-property laws.

You may use the website only for personal or authorized business purchasing purposes.

You may not reproduce, distribute, modify, publish, sell, license, reverse engineer, or commercially exploit website content without our prior written authorization.

Third-party product names, logos, trademarks, and images remain the property of their respective owners.

16. Reviews and Other User Content

When you submit a review, photo, testimonial, suggestion, or other content, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute that content for lawful business and promotional purposes.

You represent that submitted content:

  • Is accurate to the best of your knowledge

  • Does not violate another party’s rights

  • Does not contain unlawful, threatening, defamatory, fraudulent, or malicious material

  • Does not contain malware or harmful code

We may remove or decline to publish content at our discretion, subject to applicable law.

17. Third-Party Services and Links

The website may contain links to or integrations with third-party websites and services.

We do not control and are not responsible for third-party content, availability, security, privacy practices, products, or services. Your use of a third-party service is subject to that party’s terms and policies.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.

We do not warrant that:

  • The website will always be uninterrupted, secure, or error-free

  • Product descriptions will be free of every error

  • Website defects will always be corrected

  • The website or server will be free of harmful components

Products may be subject to warranties offered by their manufacturers. We do not provide additional warranties except where expressly stated in writing.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, On Duty Uniforms and Streber LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, an order, a product, a delay, or these Terms.

To the fullest extent permitted by law, our total liability arising from a particular order or product will not exceed the amount you paid us for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Streber LLC, On Duty Uniforms, and their owners, employees, agents, and service providers from claims, damages, liabilities, costs, and expenses arising from:

  • Your unlawful or unauthorized use of the website or a product

  • Your violation of these Terms

  • Materials, artwork, logos, or instructions you submit

  • Your infringement of another party’s rights

  • Your fraudulent or misleading conduct

This section does not require indemnification for losses caused solely by our own unlawful conduct.

21. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms, the website, or a purchase must be brought in a court with appropriate jurisdiction located in Dutchess County, New York, unless applicable consumer law requires otherwise.

22. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

23. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

24. Entire Agreement

These Terms, together with the Privacy Policy, Shipping and Returns Policy, order details, product-specific disclosures, and any applicable department-program terms, constitute the agreement between you and us concerning the website and your purchase.

25. Changes to These Terms

Changes apply prospectively unless otherwise stated or permitted by law.
